In Illinois, the law states that couples must divide property in a manner that is equitable, but not necessarily equal. In the event that an agreement regarding the provisions of a parenting plan cannot be reached, the court will make a determination about parental responsibilities by considering the best interests of the child (See: 750 ILCS 5/600).
Finally, when one party in the relationship makes significantly more money than does the other, this party may be ordered to pay spousal maintenance – also called alimony – to the financially dependent spouse. In order to make a determination about whether or not a spouse should receive a maintenance award, the court will consider the income and property of each party, the needs of each party, the present and future earning capacity of each party, the standard of living established during the course of the marriage, the length of the marriage, and a number of other factors the court finds relevant, per 750 ILCS 5/504.
