Resolving Life's Challenges to Get You to a BETTER PLACE

Lincoln Park Divorce Attorney Helping Chicago Clients

When a couple marries, the furthest thing from their mind is the prospect of getting divorced. However, with time and stress, many couples decide that separating and dissolving their marriage is the best thing to do. When you are going through a divorce in Lincoln Park, our Illinois divorce attorneys at the Arami Law can help you to understand the process and laws, and can assist you in obtaining a fair divorce settlement.

Division of Property in Divorce in Illinois

For couples parting ways, the most complex issue in the divorce is typically how property will be divided amongst the two parties. In Illinois, the law states that couples must divide property in a manner that is equitable, but not necessarily equal. Further, all assets and property that are acquired by a party to the marriage after the date of the marriage are considered to be marital property, and are subject to division at the termination of a marriage as such.

Allocation of Parental Responsibilities

Each parent has a duty to provide for their child in Illinois. In Illinois, the term “parental responsibilities” means both time spent with the child, as well as significant decision-making responsibilities. Parents in Illinois who are separating are responsible for creating a parenting plan that addresses both. In the event that an agreement regarding the provisions of a parenting plan cannot be reached, the court will make a determination about parental responsibilities by considering the best interests of the child (See: 750 ILCS 5/600).

Spousal Maintenance

Finally, when one party in the relationship makes significantly more money than does the other, this party may be ordered to pay spousal maintenance – also called alimony – to the financially dependent spouse. In order to make a determination about whether or not a spouse should receive a maintenance award, the court will consider the income and property of each party, the needs of each party, the present and future earning capacity of each party, the standard of living established during the course of the marriage, the length of the marriage, and a number of other factors the court finds relevant, per 750 ILCS 5/504.
