There are two different ways in which an Illinois court can allocate parental responsibilities:

  • Court can decide what kind of arrangement is in the best interests of the child and can allocate parental responsibilities through an allocation judgment; or
  • Parents can reach an agreement about how they will share parental responsibilities in a parenting plan, and the court can approve the parenting plan if the terms are in the best interests of the child.

The best interests of the child should always come first when determining how parental responsibilities should be allocated in Illinois.

Significant Decision-Making Responsibilities in Hinsdale

The allocation of significant decision-making responsibilities usually includes determining how parents will share in making decisions about the following important issues concerning their child’s well-being and upbringing:

  • Child’s education, including where the child will attend school;
  • Child’s health care, including decisions about medical care, dental care, and psychological care; and
