Glenview Financial Issues and Family Law
Many different financial issues can arise in family law cases. We routinely assist clients with financial matters pertaining to family law, such as:
- Property division in a divorce: All property will be classified as either separate property or marital property. Separate property will not be divided, but all marital property will be divided according to the theory of equitable distribution. In equitable distribution states like Ohio, marital property is divided in a way that the court determines to be fair to the parties but not necessarily equal or 50/50.
- Spousal support: Illinois courts can award spousal support, also known as spousal maintenance or alimony, in a divorce case. In order to award support, the court will first determine whether spousal maintenance is appropriate given the circumstances of the parties and their marriage. Then, if it determines that support is appropriate, for most cases, the court will use a formula to calculate the amount and duration of spousal maintenance.
- Child support: Illinois uses an income shares model for child support, which means that courts combine the incomes of both parents to determine a total child support obligation, and then each parent is assigned a portion of the total obligation based on their individual net incomes and other factors such as the number of overnights each parent has with the child.
Child Custody Issues in Glenview
Child custody cases, or the allocation of parental responsibilities under Illinois law, are also common family law matters. Illinois courts allocate both significant decision-making responsibilities to parents and parenting time rather than awarding child custody.
In some custody cases, paternity or parentage must be established in order for the father to seek parental responsibilities. For all child custody cases, courts focus on what is in the best interests of the child when allocating parental responsibilities.
