To get divorced in Illinois, the Illinois Marriage and Dissolution of Marriage Act (IMDMA) requires you or your spouse to plead that “irreconcilable differences have caused the irretrievable breakdown of the marriage.” As soon as you live separate and apart for six months or more, there is an irrebuttable presumption that you have met this requirement.
Beyond the requirements to file for and have your divorce granted, you should also be thinking about financial issues in divorce cases. Parental responsibilities include both significant decision-making responsibilities (formerly known as legal custody) and parenting time (formerly known as physical custody and visitation). For both types of parental responsibilities, the court allocates those responsibilities based on what is in the best interests of the child.
